Why INEC must review APC Ogun gov election result - PDP

The Peoples Democratic Party, has demanded the Independent National Electoral Committee to review the wrongful declaration and return of the All Progressives Congress, Governor-elect, Adedapo Abiodun, within seven days as the only option available to INEC in its powers under Section 65 (1) of the Electoral Act, 2022, because the result declared by INEC is completely at variance with the provisions of the Electoral Act, 2022 and guidelines issues by INEC for the conduct of the election.

For the avoidance of doubt he said Section 65 provides that, “The decision of the returning officer shall be final on any question arising from or relating to— unmarked ballot paper; rejected ballot paper; and declaration of scores of candidates and the return of a candidate.

Speaking further he said, “In such circumstance, Section 24 of the Electoral Act, 2022 expressly mandates INEC to appoint a new date for the conduct of the polls in the Polling Units where election did not hold or was cancelled before any Return can be made. “Where the Commission appoints a substituted date in accordance with subsections and , there shall be no return for the election until polling has taken place in the area or areas affected.”
